Mr. Eviota is a highly trained specialist in energy law, corporate law, special projects and public utilities. He obtained his law degree from the Ateneo De Manila School of Law in 1988.

He was admitted to the Philippine Bar in 1989 and has established valuable linkages from three (3) years worth of government service prior to joining Bauang Private Power Corporation (BPPC) as its in-house counsel for twelve (12) years. BPPC, is a subsidiary of publicly-traded First Gen Corporation (“First Gen”), one of the country’s largest energy firms operating natural gas, diesel, hydro and wind power plants.

As the in-house counsel of BPPC, Mr. Eviota had direct and extensive experience in the interpretation, implementation and enforcement of a 15-year Build-Operate-Transfer (BOT) Contract with the National Power Corporation for the 225 MW Bauang Diesel Power Plant located in Bauang, La Union. His work included handling of various administrative, commercial, labor, tax and regulatory matters of the company, overseeing the activities of retained counsels, and regular coordination with various government agencies, local governments and other independent power producers.

Mr. Eviota also provided legal support and assistance to various BPPC-affiliates, including:

  • Panay Power Corporation (PPC) –negotiation, documentation and implementation of the Power Purchase Agreement, the Engineering, Procurement and Construction contract and the Fuel Supply Agreement; and various legal services relative to the operation and maintenance of the 75 MW Diesel-Fired Power Plant in Iloilo City (from 1996 up the sale of the plant in 2001 to Metro Global Holdings); and
  • Batangas Cogen Corporation (BCC) – conceptualization, negotiation and documentation of shareholders agreements, the Engineering, Procurement and Construction contract, and the acquisition and maintenance of PEZA registration for a proposed co-generation power plant at the First Philippine Industrial Park in Batangas Province.

As a member of the First Gen Project Development Group, Mr. Eviota actively participated in the conduct of legal due diligence and preparation of bids for the acquisition of the following power plant facilities or ownership interests therein:

  • 1.6 MW Agusan Hydrolectric Power Plant located in Agusan, Bukidnon;
  • 600 MW Masinloc Coal Plant located in Masinloc, Zambales;
  • 600 MW Calaca Coal Plant located in Calaca, Batangas;
  • 700 MW Tiwi-Makban Geothermal Plant located in Tiwi, Albay and Makban, Batangas;
  • 100 MW Pantabangan Hydroelectric Power Plant and the 12 MW Masiway Hydroelectric Power Plant both located at Pantabangan, Nueva Ecija;
  • 360 MW Magat Hydro Plant located in Ramon, Isabela;
  • NPC-SPUG for Marinduque, Romblon and Tablas areas;
  • 75 MW Ambuklao Hydroelectric Power Plant located in Bokod, Benguet and the 100 MW Binga Hydroelectric Power Plant located in Itogon, Benguet;
  • El Paso Corporation (“El Paso”) interest in the Subic Bay Terminal, the Clark Terminal and the Clark Pipeline;
  • Delta P diesel power plant in Palawan;
  • Quezon Power in Mauban, Quezon; and
  • Mindanao Coal project in Cagayan de Or0 City.

Following successful bids by First Gen for the 1.6 MW Agusan and the 112 MW Pantabangan-Masiway hydroelectric power plants, Mr. Eviota was likewise involved in the documentation and implementation of acquisition documents and various post-bidding related work including the titling of lands, acquisition of operating permits, negotiation and documentation of an interim supply agreement with local utilities.
